Botanica Grove Naturopathy

These Terms and Conditions (“Terms”) are a contract between you and the person identified as “we”, “us” or “our” in the Schedule below.

If you are under the age of 18, a parent or guardian must read and agree to these Terms on your behalf. Any reference to “you” includes your parent or guardian where applicable.

These Terms apply when you purchase products and/or services from us. Please read them carefully alongside any other rules or guidelines posted on our website or otherwise communicated to you from time to time.

1. Your Responsibilities

What you must do

When working with Botanica Grove Naturopathy, you agree to:

  • Arrive on time for your consultations.

  • Be courteous and respectful to our practitioners, staff, and other clients.

  • Complete any intake forms, consent forms and follow-up documentation required by us.

  • Provide accurate and complete health information, including:

    • Current medical conditions

    • Healthcare professionals you are currently working with

    • Allergies or intolerances

    • Medications or supplements you are taking

    • Any dosage changes during your care

    • Recent vaccinations or boosters

    • Dietary preferences (e.g. vegan or vegetarian)

    • Pregnancy, breastfeeding, or trying to conceive

    • Any other information relevant to your care

  • Comply with any health and safety guidelines required by us.

  • Deal with us in good faith.

  • Comply with all applicable laws and these Terms.

You agree to notify us if any of your health information changes while receiving products or services from us.

Overseas clients

If you are located outside Australia, it is your responsibility to ensure the products or services you order can be imported and used legally in your country.

We are not responsible if products are confiscated or restricted due to local laws.

Refusal of service

If you fail to comply with these Terms, we reserve the right to cease providing products or services at our discretion.

2. Fees and Payment

Orders subject to availability

All orders are subject to acceptance and product availability. A contract is only formed once we accept your order.

Orders placed with third-party suppliers

We are not responsible for products purchased through third-party practitioner dispensaries such as:

  • Vital.ly

  • Ariya

  • Natural Script

  • Oborne Health Supplies

If purchasing through these platforms, you agree to comply with their terms and conditions and relevant laws.

Fees

Fees for our services and products are listed on our website or otherwise provided in writing.

All fees are quoted in Australian dollars (AUD).
Where applicable, GST will be added.

We reserve the right to change our fees at any time with notice.

Clients outside Australia are responsible for customs duties, import taxes or fees.

Payment

Payment terms vary depending on the product or service purchased.
You agree to pay in accordance with the payment terms provided at the time of booking or purchase.

3. Warranties

Issues with products

If there is an issue with your order (for example damage, missing products, or incorrect items):

Products purchased from us

You must notify us within 7 days of delivery.

Include:

  • Proof of purchase

  • Details of the issue

  • Any supporting documentation requested

If products must be returned, you are responsible for return shipping and insurance costs.

Products purchased through third-party suppliers

You must contact the supplier directly.

Consumer rights

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

If there is a major failure, you are entitled to:

  • Cancel the service contract

  • Receive a refund for the unused portion

  • Receive compensation for reduced value

For non-major failures, we will rectify the issue within a reasonable time.

These rights exist in addition to any rights available under Australian law.

Refunds

Refunds will only be provided where:

  • We cannot fulfil an order

  • It is reasonable to do so

  • It is required under Australian Consumer Law

  • We agree to the refund in writing

Refunds are not provided for change of mind.

Allergies and reactions

Some products may contain potential allergens including but not limited to:

  • Nuts

  • Gluten

  • Dairy

  • Herbal ingredients contraindicated for certain conditions

You are responsible for reviewing ingredient lists before purchase and contacting us if unsure.

If you experience a reaction:

  • Discontinue use immediately

  • Contact us

We are not liable for allergic or adverse reactions, and refunds are not issued on this basis.

No guarantee of outcomes

Health outcomes vary between individuals.

We do not guarantee specific results including:

  • Cure of illness

  • Resolution of symptoms

  • Specific health outcomes

Limitation of liability

If a valid warranty claim is made, our liability is limited to:

  • Replacing the product

  • Supplying equivalent goods

  • Re-supplying the service

  • Paying the cost of having the service supplied again

We are not liable for consequential loss, including loss of income, business opportunity, or reputation.

4. Intellectual Property

Unless otherwise stated, all information, resources and materials provided through our services remain the intellectual property of Botanica Grove Naturopathy.

Purchasing our services or products does not grant ownership or rights to reproduce our materials.

5. Confidentiality

Our products and services are provided for personal use only.

You agree not to:

  • Copy

  • Distribute

  • Publish

  • Sell

  • Share

  • Commercially reproduce

any materials provided without written permission.

You may share recommendations, reports or test results with your GP or other healthcare providers.

6. Dispute Resolution

You agree to cooperate with us in resolving disputes, complaints or investigations arising from your use of our products or services.

7. General Terms

Medical disclaimer

Information provided by Botanica Grove Naturopathy is not a substitute for medical diagnosis or treatment.

You should:

  • Seek medical advice from your doctor when required

  • Not discontinue prescribed treatment without consulting your healthcare provider

You are responsible for decisions relating to your health.

Privacy

We collect and store personal information in accordance with our Privacy Policy, available on our website:

Force Majeure

We are not liable for delays or failure to perform obligations due to events beyond our control, including:

  • pandemics

  • natural disasters

  • strikes

  • government restrictions

  • acts of war or terrorism

Entire agreement

These Terms represent the entire agreement between you and Botanica Grove Naturopathy.

Governing law

These Terms are governed by the laws of Victoria, Australia.

Minimum Notice for Consultation Cancellation

Clients must provide 48 hours notice to cancel or reschedule consultations.

Attachment A — Products

Ordering products

Products may be ordered via:

or via practitioner dispensaries.

Practitioner-only supplements

Certain practitioner-only supplements require a consultation before purchase.

Delivery

Products will be delivered to the address provided in your order.

Delivery timeframes are estimates only, particularly where third-party suppliers are involved.

Product recalls

If a product is recalled:

  • You will be notified immediately

  • A replacement or refund will be issued

Attachment B — Services

Consultations

Booking

Consultations can be booked via:

  • Website

  • Email

  • Social media

  • Other booking systems used by the clinic

Consultations may occur via Zoom or other agreed methods.

Fees

Initial consultations must be paid in full prior to the appointment.

Return consultations may require payment within 24–48 hours of booking where applicable.

Cancellation by you

If you cancel with less than the required notice:

  • 24–48 hours notice: 50% of consultation fee

  • Less than 24 hours notice: 100% of consultation fee

Cancellation requests must be sent via email, not Instagram or text message.

Cancellation by us

If we need to cancel your consultation:

  • You will be notified in writing

  • Any prepaid fees will be refunded

Refunds

Where at least 48 hours notice is given, any prepaid consultation fees will be refunded.

Testing

Testing may be conducted through third-party laboratories.

We are not responsible for the accuracy of third-party testing.

Where tests require DNA samples (hair, saliva or blood), you authorise us to collect and send samples to laboratories. Samples will not be returned.

Tests purchased through third-party providers are non-refundable.

Testing costs are separate from consultation fees unless included in specific packages.

Packages & Programs

Packages cannot be cancelled or refunded once payment has been made.

Packages including 3–5 consultations must be used within 3 months of purchase.

Other Services

Advice provided during mentoring sessions does not create a practitioner-client relationship unless a formal consultation occurs.

Botanica Grove Naturopathy is not liable for naturopathic advice applied outside a client relationship.
